  47.                         SETTLEMENT AGREEMENT

  50. {PLAINTIFF_NAME} of {PLAINTIFF_ADDRESS} (Plaintiff) and 
  51. {DEFENDANT_NAME} of {DEFENDANT_ADDRESS} (Defendant), being the 
  52. plaintiff and defendant, respectively, in the case of 
  53. {CASE_NAME}, Civil Action No. {CAUSE_NO} now pending in the 
  54. {COURT_DESCRIPTION}, hereby agree to settle this case on the 
  55. following terms:
  56.  
  57. 1.  Defendant will pay to plaintiff ${PAYMENT_AMOUNT} on {FIRST_DATE} 
  58. and the same amount each month thereafter, until the total amount 
  59. of ${TOTAL_AMOUNT} has been paid in full, together with interest 
  60. at the rate of {INTEREST%} per year on the balance owing, with 
  61. each payment when received being applied first to interest and 
  62. then to principal.

  65. 2.  Plaintiff will continue the case on the docket of the Court 
  66. and will not seek a judgment or a default so long as defendant 
  67. continues making the above-described monthly payments.

  69. 3.  Upon completion of the above-described monthly payments, by 
  70. payment in full of the above-stated total amount plus interest, 
  71. then Plaintiff will execute and deliver to Defendant for filing 
  72. in Court a stipulation or praecipe in form satisfactory to the 
  73. Defendant, noting that the case has been compromised and settled 
  74. and dismissing the case, with prejudice.  In addition, Plaintiff 
  75. will execute, in favor of Defendant and all other makers, 
  76. endorsees and guarantors on all promissory notes and other 
  77. obligations sued on in this case, a full release of all claims 
  78. and demands made therein.  Further, Plaintiff will mark all 
  79. promissory notes and other obligations sued on in this case as
  80. having been "Paid and Satisfied in Full" and deliver them to 
  81. Defendant.

  83. 4.  If Defendant fails to make any one or more of the above-
  84. described monthly payments when due, or fails to pay in full 
  85. the above-stated total amount plus interest when due, then 
  86. Plaintiff shall have the right, on ten days' written notice, 
  87. to immediate judgment for the full amount sued on or, in the 
  88. alternative, at Plaintiff's option, for the total amount 
  89. specified in this agreement, together with costs and interest, 
  90. less any amounts theretofore paid pursuant to this Agreement.

  92. 5.  This agreement shall inure to the benefit of and be binding 
  93. upon the heirs, legal representatives, successors and assigns of
  94. the parties.

  108.                         SETTLEMENT AGREEMENT

  111. {DEBTOR_NAME} of {DEBTOR_ADDRESS} (Debtor) and {CREDITOR_NAME} 
  112. of {CREDITOR_ADDRESS} (Creditor) and {GUARANTOR_NAME} of 
  113. {GUARANTOR_ADDRESS} (Guarantor) hereby agree as follows, in order 
  114. to settle amicably the controversy which has arisen between the 
  115. Debtor and Creditor relating to the following described debt:

  119. 1.  Debtor will pay to Creditor the total amount of ${TOTAL_AMOUNT}, 
  120. together with interest on the balances thereof at the rate of

  122. per month, beginning on {START_DATE}, with each payment being 
  123. applied first to interest and then to principal.

  126. 2.  In order to induce Creditor to accept Debtor's above promise 
  127. to pay Creditor, and in consideration of Creditor's acceptance, 
  128. Guarantor hereby guarantees Debtor's punctual payment to Creditor 
  129. in strict accordance with the terms set forth, above.

  131. 3.  Creditor will accept the above payments in full satisfaction 
  132. of all amounts claimed from Debtor and will execute and deliver to
  133. both Debtor and Guarantor duplicate original releases in favor of 
  134. Debtor and Guarantor, in form satisfactory to them, upon receipt 
  135. of full payment.

  137. 4.  If Debtor fails to make any one or more of the above-specified 
  138. payments when due, then Creditor may proceed against Debtor both 
  139. under the agreement and under Creditor's original claim against the 
  140. Debtor.  Creditor may also at any time after any default by Debtor 
  141. make demand upon Guarantor for payments and may proceed against 
  142. Guarantor if Guarantor fails to make such payment within ten (10) 
  143. days after such demand.

  145. 5.  This agreement shall inure to the benefit of and be binding 
  146. upon the heirs, legal representatives, successors and assigns of 
  147. the parties.

  174. contracts judgments, damages, accounts, reckonings, executions, 
  175. claims and liabilities whatsoever of every name and nature, 
  176. whether known or unknown, whether or not well founded in fact or 
  177. in law and whether in law or equity, or otherwise, which the 
  178. undersigned ever had, now has, or which the undersigned or the 
  179. undersigned's heirs, executors or administrators can, shall or 
  180. may have for or by reason of any matter, cause, or anything 
  181. whatsoever, from the beginning of the world to this date.
